Welcome to SongVet. By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully before using the platform.
1. Service Description
SongVet provides automated audio analysis tools that compare uploaded audio files against a database of published songs using acoustic fingerprinting, vector similarity search, and AI detection methods. Our service generates risk assessments and analysis reports to help creators evaluate potential copyright similarities in their music.
SongVet does not provide legal counsel of any kind. Our analysis results are for informational purposes only and should never be relied upon as a substitute for professional legal advice. No output from SongVet — including risk scores, certificates, reports, or any other analysis — constitutes a legal opinion, legal certification, or determination of copyright status or protection. SongVet does not legally certify that any song is protected from copyright claims or free from copyright infringement. If you need legal advice, consult an attorney familiar with music industry law.
2. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
SongVet does not warrant or guarantee that:
- Analysis results are complete, accurate, or error-free
- A low risk score means your audio is free from copyright claims or legally protected
- A high risk score definitively indicates copyright infringement
- The service will detect all potential copyright similarities
- Any song analyzed through our service is free from copyright infringement or protected from copyright claims
- The service will be available without interruption
SongVet does not legally certify that any song is protected from copyright claims. Results are generated by automated systems with inherent limitations. False positives and false negatives may occur. SongVet does not provide legal counsel of any kind. Always use good judgment, and consult a qualified attorney familiar with music industry law for legal guidance regarding copyright matters.
3. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SONGVET AND ITS OPERATORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE OR ACCOUNTABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Copyright infringement claims or lawsuits arising from the use or distribution of audio analyzed by our service
- Content takedowns, DMCA notices, or platform removals
- Lost revenue, profits, or business opportunities
- Reliance on analysis results for business or legal decisions
- Any consequences resulting from your use of a song, regardless of the risk score or analysis provided by SongVet
SongVet is not liable or accountable for your use of any song analyzed through our service. Our analysis does not constitute legal certification or protection. Our total liability for any claim arising from use of the service shall not exceed the amount you paid to SongVet in the twelve (12) months preceding the claim.
4. User Responsibilities
By using SongVet, you acknowledge and agree that:
- You are solely responsible for your use of any song, regardless of the risk score, analysis results, or any other output provided by SongVet
- You are solely responsible for ensuring your audio content complies with all applicable copyright laws
- You have the right to upload and analyze any audio files you submit to the service
- SongVet analysis results do not release you from your legal obligations regarding copyright compliance
- SongVet does not provide legal counsel of any kind, and you will not treat any output from SongVet as legal advice
- You will not use SongVet results as the sole basis for legal decisions
- You should always use good judgment regarding your music and its distribution
- If you have concerns about potential legal issues, you should consult an attorney familiar with music industry law
5. Blockchain Ownership Certificates
SongVet may issue blockchain-based ownership certificates (ERC-721 NFTs) that record the creator's ownership claim of an audio track on the Ethereum blockchain. These certificates:
- Are timestamped, tamper-proof records of the creator's claim that they own or created the track
- Are not a guarantee that the audio is free from copyright claims or infringement
- Are not a legal determination of copyright status or clearance
- Do not verify or guarantee the validity of the ownership claim — SongVet does not independently confirm that the uploader is the rightful owner
- Cannot be revoked or modified once minted on the blockchain
- Are separate from the analysis report (risk score, match results), which is informational only
6. Intellectual Property and Uploaded Files
You retain all rights to audio files you upload to SongVet. By uploading a file, you grant SongVet a limited, non-exclusive license to process and analyze the file for the purpose of providing the service.
Uploaded audio files are processed for analysis and then deleted from our servers. However, acoustic fingerprint data derived from your audio may be retained in our detection database to improve the accuracy of future scans, unless you request its removal.
7. Subscription and Payments
SongVet offers free and paid subscription tiers. Payment processing is handled by Stripe. By subscribing to a paid plan, you agree to the following:
- Subscription fees are billed on a recurring monthly basis
- You may cancel your subscription at any time through your account settings or Stripe customer portal
- Cancellation takes effect at the end of the current billing period
- Refunds are handled on a case-by-case basis
- SongVet reserves the right to modify pricing with reasonable notice
8. Data and Privacy
Your use of SongVet is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the service, you consent to the data practices described in our Privacy Policy.
9. Modifications to Terms
SongVet reserves the right to modify these Terms of Service at any time. We will notify users of material changes by updating the “Last updated” date at the top of this page. Your continued use of the service after changes are posted constitutes acceptance of the revised terms.
10. Termination
SongVet may suspend or terminate your access to the service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the service ceases immediately.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
